HIPAA Compliance

The Health Insurance Portability and Accountability Act (HIPAA) lays out privacy and security standards that protect the confidentiality of patient health information. In terms of video conferencing, the solution and security architecture must provide end-to-end encryption and meeting access controls so data in transit cannot be intercepted.

  • Ensure the confidentiality, integrity, and availability of all electronic protected health information the covered entity creates, receives, maintains, or transmits.
  • Protect against any reasonably anticipated threats or hazards to the security or integrity of such information.
  • Protect against any reasonably anticipated uses or disclosures of such information that are not permitted or required under the privacy regulations.
  • Ensure compliance by its workforce.

We have a signed HIPAA Business Associate Agreement (BAA) for our platform, meaning we are responsible for keeping your patient information secure and reporting security breaches involving personal healthcare information. The following table demonstrates how PsychNEXUS supports HIPAA compliance based on the HIPAA Security Rule published in the USA Federal Register on February 20, 2003 (45 CFR Parts 160, 162, and 164 Health Insurance Reform: Security Standards; Final Rule).

SECURITY AND ENCRYPTION +

Only members invited by account administrators can host meetings in accounts with multiple members. The host controls meeting attendance through the use of meeting IDs and passwords. Each meeting can only have one host. The host can screen share or lock screen sharing. The host has complete control of the meeting and meeting attendees, with features such as lock meeting, expel attendees, mute/unmute all, lock screen sharing, and end meeting. Our platform employs industry-standard end-to-end Advanced Encryption Standard (AES) encryption using 256-bit keys to protect meetings.

PsychNEXUS utilises encryption that fully complies with HIPAA Security Standards to ensure the security and privacy of patient data. Screen sharing in healthcare medical professional and authorised healthcare partners can use screen sharing and video and audio conferencing to meet with patients and other healthcare professionals to screen-share health records and other resources.

MEDICARE (AUSTRALIA ONLY) +

Telehealth is a new way of practising for most medical practitioners, and it presents new clinical and technological challenges.

 

There is a wide range of technology available to support video-conferencing. While the Australian Government have not mandated any particular technological solution for the delivery of Medicare-eligible video consultations, there is a range of material available to guide practitioners on what to consider when setting up and performing video consultations.

Although videoconferencing is new to Medicare reimbursement, video conferencing is already widely used in health, particularly within state health systems, and there is a wide range of existing technical standards that apply to video conferencing technology.

It is clear that while all medical specialities can potentially conduct consultations via video link, the specific technical requirements vary from speciality to specialty. Different types of specialist consultations can be satisfactorily performed using different types of technology, taking into account the patient’s particular medical condition, local infrastructure and patient/practitioner preferences.

In general, clinicians providing MBS billed telehealth services should be confident that the technical solution they choose is:

    • capable of providing sufficient video quality for the clinical service being provided; and
    • sufficiently secure to ensure normal privacy requirements for health information are met.

PsychNEXUS goes further, providing therapists a fully HIPAA Compliant platform as an individual therapist. This is the minimum required for delivering e-Health consultations in the USA, and provides the highest level of assurance of security and confidentiality that an individual therapist can obtain, at a price they can afford.

Individual clinicians will also need to be confident that the technology used is able to satisfy the item descriptor and that software and hardware used to deliver a video conference meets the applicable laws for security and privacy.

Outside of the Medicare environment, video conferencing is already widespread and established practice in state public health systems, and there are already a number of guidelines and position statements on the clinical use of telehealth available to doctors.

TELEHEALTH ELIGIBILITY +

Medicare benefits are available for video consultations between specialists and patients who are located in telehealth eligible areas. They are also available in eligible aged care facilities and Aboriginal Medical Services throughout Australia.

Medicare benefits are also available for clinical support provided by a health professional who is with the patient during the video consultation. At the time of the video consultation, there must be 15 km by road between a patient and a specialist, consultant physician, or consultant psychiatrist.

Geographic eligibility for telehealth services is determined by the Australian Standard Geographical Classification – Remoteness Area (RA) classification, which is a numerical system between 1 and 5. A telehealth eligible area is outside of a major city (RA1).

You can check if a location is telehealth eligible by using Search the map on the Department of Health Doctor Connect website. Choose the ‘ASGC Remoteness Areas Layer’ and enter the address of your patient’s location during the consultation.

Exceptions to this are where a patient is:

    • living in an eligible residential aged care facility at an eligible Aboriginal Medical Service (AMS), or
    • at an eligible Aboriginal Community Controlled Health Service (ACCHS)

To be considered an eligible Aboriginal Medical Service or Aboriginal Community Controlled Health Service, the practice must hold a current exemption granted under section 19(2) of the Health Insurance Act 1973.
